Terms and Conditions

1. Definitions

In this Agreement, unless the context otherwise requires, the following expressions have the following meanings:

1.1. 'EC Shop' means Empowered Consumerism Shop, whose office is at Unit 301 AIC Burgundy Empire Tower, Garnet and Sapphire Streets, ADB Ave., Ortigas Center, Pasig City.

1.2. 'Goods' means the goods or services supplied by Empowered Consumerism.

1.3. 'Consumer' means the person or company who purchases or agrees to purchase goods or services from Empowered Consumerism.


2. General

2.1. These terms and conditions of sale apply to all goods supplied by EC Shop.

2.2. No contract exists between the Consumer and EC Shop for the sale of any goods or services until EC Shop has received and accepted your order and EC Shop has received payment in full (in cleared funds). Once EC Shop does so, there is a binding legal contract between us.

2.3. An acknowledgment of your order will be sent to you via email when you place your order, but acceptance of your offer to buy the Goods will not take place until after your payment is taken and you receive your confirmation of payment. At this point, a binding legal contract is created, and any contract is subject to these Terms and Conditions.

2.4. EC Shop may change these terms and conditions of sale without notice to you in relation to future sales.

2.5. The contract is subject to your right of cancellation (see Section 7).

2.6. EC Shop reserves the right to decline any order for any reason.


3. Description of the Goods

3.1. The description and price of the goods you order will be as shown on EC Shop’s website at the time you place your order.

3.2. The goods are subject to availability. If upon receipt of your order the goods you have ordered are not available in stock, EC Shop will inform you as soon as possible.


4. Price of the Goods

4.1. Every effort is made to ensure that prices shown on EC Shop’s website are accurate at the time you place your order.

4.2. In addition to the price, you may be required to pay:

4.2.1. Delivery charges

4.2.2. Value Added Tax and any other fees

5. Payment

5.1. Payment for the goods and delivery charges can be made by any method shown on EC Shop’s website at the time you place your order.

5.2. Payment shall be due before the delivery date and made when the order is placed.

5.3. There will be no delivery until cleared funds are received.


6. Delivery

6.1. Confirmed orders placed before 1 pm on a working day (Monday to Friday excluding public holidays) will be processed that day and delivered as per the requested delivery option, provided no additional security checks are required, cleared funds are received, and all items are in stock.

6.2. The goods you order will be delivered to the delivery/shipping address given when you place your order.

6.3. If delivery cannot be made to your delivery/shipping address for reasons under EC Shop's control, EC Shop will inform you as soon as possible and refund or re-credit you for any sum that has been paid by you or debited from your credit card for delivery.

6.4. If you deliberately fail to take delivery of the goods when delivery is attempted twice, then EC Shop may:

6.4.1. Store the goods until actual delivery and charge you for reasonable costs of storage; or

6.4.2. Sell the goods at the best readily obtainable price and (after deducting all reasonable storage and selling expenses) credit to you any excess over the price you agreed to pay for the goods or charge you for any shortfall below the price you agreed to pay for the goods.

6.5. Every effort will be made to deliver the goods as soon as possible after your order has been accepted. However, EC Shop will not be liable for any loss or damage suffered by you through reasonable or unavoidable delays in delivery.

6.6. Time for delivery shall not be of the essence. The goods may be delivered by EC Shop in advance of the quoted delivery date.

6.7. Upon receipt of your order, you will be asked to sign for the goods received in good condition. Failure to do so may affect any warranty claims that you make thereafter.

6.8. If delivery was made and the goods were returned to sender (RTS), and you decide to change the delivery address, you are required to pay for an additional delivery charge.


7. Your Right of Cancellation

7.1. You have the right to cancel the contract at any time up to the end of 7 calendar days after you have ordered the goods.

7.2. To exercise your right of cancellation, you must give written notice to EC Shop by letter or email, providing details of the goods ordered and any order reference. Notification by phone will not be honored.

7.3. Once you have notified EC Shop that you are canceling the contract, EC Shop will refund you within 20 days for any sum that has been paid for the goods. Any associated charges shall be incurred.

7.4. For credit card transactions that are requested and approved within the 7 calendar days allowance, you may call your credit card bank and request a chargeback.

7.5. Points and commissions generated will be reversed once the order has been canceled.

7.5.1. Reversal of payment of commissions shall incur charges.

7.6. In the event that the credit card bank approves the request for a chargeback, all bank charges and penalties will be shouldered by the consumer or the individual who made the transaction.


8. Branch Pickup

Goods purchased from your EC Online Shop tagged for branch pickup must be claimed within 10 working days from the date of purchase.


9. Returns

We hope you will be delighted with your purchase. However, if you are not, you have 10 calendar days from the date you receive the goods to contact us to arrange the return of the item. To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging with proof of purchase. You must contact us before shipping the item back to us. Once your item has been received, it will be inspected. Once approved, your refund will be processed. This should take no more than 5 days (depending on the method used). You will be responsible for the shipping cost for returning your item, and outward shipping costs are non-refundable. Your refund will be for the item(s) only and shall incur charges.

10. Warranty

11.1. All new goods supplied by EC Shop are warranted free from defects for the duration of the manufacturer’s warranty from the date of supply (unless otherwise stated). This warranty does not affect your statutory rights as a consumer.

11.2. This warranty does not apply to any defect in the goods arising from fair wear and tear, willful damage, accident, negligence by you or any third party, or use otherwise than as recommended by EC Shop.

11.3. If the goods supplied to you are damaged on delivery, you should notify EC Shop in writing via the email address shown below within 48 hours.

11.4. If the goods supplied to you develop a defect while under warranty or you have any other complaint about the goods, you should notify EC Shop in writing via the email address shown below as soon as possible, but in any event within 7 days of the date you discovered or ought to have discovered the damage, defect or complaint.
